Terms of Service

Welcome to Seekaboat ("Platform", "we", "our", or "us"). By accessing or using our website and services, you ("User", "Guest") agree to be bound by these Terms of Service.

1. Role of the Platform

Seekaboat operates as a digital marketplace connecting tourists and guests with independent local boat owners, captains, and charter operators ("Partners").

We are an intermediary: We do not own, operate, or manage the boats listed on our Platform.

Contract of Carriage: The actual rental agreement and responsibility for the maritime journey lie strictly between the Guest and the Partner.

2. Booking and Payments

Transparent Pricing: The price displayed at the time of booking is the final rental price. Partners are strictly prohibited from charging unexpected or hidden fees on the dock (such as mandatory fuel surcharges, fake port taxes, or mandatory tips) unless explicitly stated on the boat's listing page.

Payment Methods: Guests may choose to pay a deposit online or pay the full amount upfront.

Processing Fees: If a Guest chooses to pay 100% of the booking amount online via our payment gateway (Paymob), an online processing fee (approximately 3%) will be added to the total at checkout. This fee covers the banking transaction costs and is non-refundable.

3. Passenger Manifest ("Ornik") and Legal ID Requirements

To comply with the laws of the Arab Republic of Egypt, the Coast Guard, and the Tourist Police, all boats must submit a digital passenger manifest ("Ornik") before departing the marina.

Guest Responsibility: You are required to provide accurate names, nationalities, and passport/ID numbers for all passengers through the Platform prior to your trip.

Failure to Comply: If you fail to provide accurate identification data, or refuse to present your original physical Passport/ID at the marina, the Coast Guard will deny departure. In this event, the booking will be canceled, and no refund will be issued.

4. User Conduct and Safety

Punctuality: Guests must arrive at the designated marina at least 15–30 minutes before departure.

Safety Rules: The Captain holds ultimate authority on the boat. Guests must follow all safety instructions. The Captain reserves the right to terminate the trip early without a refund if Guests engage in illegal activities, severe intoxication, or unsafe behavior.

5. Limitation of Liability

Seekaboat verifies its Partners, but we are not liable for personal injury, property damage, delays, or losses that occur during the maritime trip.

Any claims regarding the quality of the boat or the behavior of the crew should be directed to our Support Team via the in-app chat so we can mediate the dispute, but our financial liability is limited to the commission earned by the Platform for your specific booking.

6. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hurghada, Red Sea Governorate.
